I think people on H1/H4 are not eligible for medicare. I think you need to be a permanent residence or citizen to avail medicare benefits.

I did contemplate not filing for AP and keeping h1 and infact planned to get stamping; but after long thoughts i let it go. I figured not filing AP is not worth the risk.
IMO you should get AP and then travel, you sure can go for h1 stamping.

What happens if I am in the 6th year of my H1, have the LC and I140, both approved from my current employer, and file for H1 extension while waiting on the retrogression...By all means, I will get the 3 year extension...
But, here's what is interesting I also have a concurrent H1 with another employer since the 5th year of my 6 year stay from the day I first entered on a H1. Assuming I have the LC and I140 approved on my 1st H1 and get the 3 year extension past the 6 years, can I get a similar 3 year extension on the concurrent H1?
Can anyone shed some light on it?

Dont we need to go to the home country for transfering from H4 to F1? Can we do it by staying in the US itself?

You need to go your home country, if you want to get the visa stamped. Here you can apply for change of status to F1. In fact as you are member of Immigrationvoice, so most likely you have applied for green card. In such case you should not go home country to apply for F1. It could be problematic. The consular officer might even reject your F1 .

Your I-485 will not get approved until the dates become current for you. For eg. say in March 2009 bulletin (which is valid from April 1st of 2009), your priority date becomes current. Your I-485 can be approved only after April 1st. Just have your wife's application ready and apply on the first day when your priority date becomes current.

The only thing I notice is a little orage that looks unusual on the tip of the rear ducks beak. If that's not it, I don't see anything.

Hi Everyone
I am filling out my i-485 and I had a couple of questions.
A) What is the Expires On field in Part 1 referring to (right under the I-94#)?
Is it the actual expiry of my Visa (as printed on the Visa) or the date written on my I-94?
B) In part 3 it asks which consulate the Visa was issued. I got it at the American embassy in Oslo. I assume this is what they want to know. Could anyone reassure me?
C) In part 3b I list my wife who is an American. I assume that I should leave her A# blank. Is this correct? I also kinda think I read somewhere that even though it says middle initial (also in 3b) you should actually list the entire middle name? Is there any truth to this?

Some had mentioned in immigration forums that you might be grilled with questions during naturalization process if you had changed employer as soon as you got your GC.If you are not planning for naturalization I assume you are fine.
A 6 month stay with current employer after GC is advised for a smooth naturalization process in future.But this is dark area as there are no posts from GC turned citizens about their experiences.

I was in same boat except my extention is for 3 year. I asked Att. Ron same that my labor and I 140 is approved and what if I leave this company and join new one and current one withdraw all papers. As per RON once you have I 140 approved and even if company withdraw it u can get 3 years unlimited extention with new company as long as new company apply for GC. Doesnot mean u need anything approved but should be under process. PERM or I 140 OR I 485.

My H1-B is expiring in December 2007. I have approved I-140 now and am hoping to get 3 year H1-B extension based on my approved I-140. Do you think I can get 3 year extension even if the visa numbers for filing AOS is current? Does AC21 apply to this case? Please suggest.
well if it is current you wont get it for 3 years, however I know AOS is unavailable, you if you apply before OCT you should be fine. once visa bulletin for OCT come out if you become current then if you file for 3 year, you will only get for 1 year
