I would appreciate any and all advice that anyone can provide:
My green card was sponsored by my husband, who has a GC. I was travelling out of the country on advance parole, when my passport got stolen, and I had to return to my original country to get a new passport issued, this took some months, during which, my advance parole to travel document expired. SO I could not enter the US. Then, a couple of weeks later, my green card approval, I485 was approved and a notice sent to me in the US. This was in June 2006. Since then, I have not received any other letter/notice, or the GC itself, and I am still stuck outside the US, without my husband. My lawyer is not doing naything about it, and I dont know what I can do?? I have tried contacting the 1800 number, and they say they put in service requests for me, but I have still not received any new information from that end as well, and each time, I have to wait 45 days before they can put in a new service request.
Help!!

My application was received on July 3 at NSC. Till now, I haven't received any notices. I got the RNs by calling USCIS.
Now, I placed an expedite order on my EAD on Friday. They sent me a mail saying my app was received on Oct 10 and not July 3 (yeah right! if it was oct 10, why would you even accept it?). So I faxed them the fedex delivery signature confirmation. Today I see a LUD on my EAD app but nothing else has changed.
Can anyone shed some light on what might possibly going on here? I can probably wait for some more time to find out for sure but I am curious. Guys with approved EAD - did you see a LUD on your app before it was approved?

I'm going to Canada on vacation for 2 days. I've read that if yr I-94 is valid and even if yr visa is expired you can return to US (thru automcatic revalidation)

2. you dont belong to a country declared as sponsoring terrorism.
My question is if you surrender yr I-94 to a Canadian inspector while crossing in to Canada, what do you show US immigration people while coming back? Do they stamp something etc? Has anyone gone thru this or knows abt this?

Hi All,
Here is my situation, would appreciate any advice or pls ping me if you are in the same boat.
I have approved an I140 from previous employer (A), (PD Mar 06) thinking that retrogression is a given for a long time I took up a full time job with employer(B), where I was consulting. My Labor and I140 has not yet been started with Emp B.
As E2, Eb3 ... is current upto Aug 17, I'm trying to file I145 based on Emp A. They are willing to file but putting a steep price (trying to take adv of the situation)
Questions
a. I know one can Self file I485, can I include my old employer job offer letter assuming that it would take > 180 days for USCIS to process the application in the mean time negotiage a deal with Emp A.
b. Self file I485, without Emp A offer letter, wait for RFE and in the mean time negotiate the deal with Emp A.
Any advice will be appreciated, please.

I recently sponsored for my uncle and his wife and had no problems. Just send the sponsor docs with I-134, letter to consulate etc. Uncle had to provide info on his ties back in India.
My last name was not same as uncle's ( guess that is what your doubt is) and that was not an issue at all.

h1bjava, why are you so much worried about denial. why are you thinking so -ve to start with.
I am not sure whether its true/law/rule, but my employer's general counsel informed me that i can do it 3 months ahead of the expiration.
To answer your red flag, i don't know. You must talk to your employer/lawyer about the possible "6month ahead plan" of applying the h1b ext.

I am on H1B. my wife is on H4. I want to apply ITIN no for my wife.
Q1. should i file under "Spouse of U.S. citizen/resident alien" or "Dependent/spouse of a nonresident alien holding a U.S. visa".
Q2. what are the documents I need to submit with the W-7 form.

The important thig is the period since yoour last admission to the US before July 2007.
Say you entered in Apr 2007 then you would not have accumulated 180 days of unauthourized stay in US before filling 485 and you will be OK.

My Labor was denied for the following reason -
Neither the earliest date listed for a recruitment step on ETA Form 9089, 03/20/2008 listed in XXX and XXX, nor the date the application was filed 8/27/2008 fall within the Prevailing wage determination validity period of 4/21/200-7/20/2008. This indicates the employer did not begin recruitement, not file the application during the Prevailing wage determination period.
Can you guys please suggest what could be done. Letter states we can ask for a review. But lawyer thinks we have start the process from the begining.
Would appreciate susgestion ASAP. Have only 15 days to respond.

What I have heard was they ask for a copy of I-140 approval. No Original needed. Also I don't think you'll get the original I-140 approval, that is a petitioner's document to own. You should be able to get a copy of I-140 from your employer/attorney.
Make sure to get the original approval copy. Not the courtesy copy. The courtesy copy will clearly state that you cannot get any benefit/proof based on that copy. When you get a copy make an extra copy of it. It will help you for future needs.

My attorney signed my I-485 AOS/EAD/AP applications and posted them on July 2nd as he was in a hurry to apply because of July 2nd scenario. Is it ok for the attorney to sign our papers. Is anybody in the same boat as me. I am a little concerned as the USCIS FAQ says application can be rejected if signature is missing. The application reached USCIS on July 3rd.

Has anyone in Charlotte, NC got a extension on the Driver's license on the basis on the H1-B renewal application receipt.
My spouse's driver's license expires this month end. I have applied for h1-b/h4 renewal, yet to receive the application receipt.But wanted to know if anyone here in Charlotte,NC got a extension/grace (30days or 90days) on the basis of the receipt.
